IN NON NEW CONDITION

DIRECTOR GENERAL OF FOREIGN TRADE,

Considering:

• a. that for more effective implementation of the Decree of the Minister of Industry and Trade No. 458/MPP/KEP/7/2003 on the Provisions and Procedures for the Import of City and Urban Buses in Non New Condition, it is considered necessary to amend several provisions in the implementing guidance of the Decision of the Director General of Foreign Trade No. 18/DAGLU/KP/VII/2003;
• b. that, for that purpose, a Decision of the Director General of Foreign Trade has to be issued.

In View of:

• 1. Decree of the Minister of Industry and Trade No. 458/MPP/KEP/7/2003 on the Provisions and Procedures for the Import of City and Urban Buses in Non New Condition;
• 2. Decision of the Director General of Foreign Trade No. 18/DAGLU/KP/VII/2003 On Implementing Guidance of Decree of the Minister of Industry and Trade No. 458/MPP/KEP/7/2003 on the Provisions and Procedures for the Import of City and Urban Buses in Non New Condition.

DECIDES:

AMENDMENT TO DECREE OF THE DIRECTOR GENERAL OF FOREIGN TRADE NO. 18/DAGLU/KP/VII/2003 ON IMPLEMENTING GUIDANCE OF DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 458/MPP/KEP/7/2003 ON THE PROVISIONS AND PROCEDURES FOR THE IMPORT OF CITY AND URBAN BUSES IN NON NEW CONDITION

Article I

Several provisions in the Decision of the Director General of Foreign Trade No. 18/DAGLU/KP/VII/2003 are amended as follows:

1. To amend and add the provisions in Article 1 so that it entirely reads as follows:

Hereinafter referred to as:

"1. Experienced company trade of imported cars and experienced in the field of goods import shall be a company that has experienced in the field of trading of four or more wheeled vehicles who has Importer’s Identity Number (API)

2. Recognition as Importer of Non-New Buses shall be an acknowledgment issued by the Director General of Foreign Trade to the Company as contemplated in point 1.

3. COI (Certificate of Inspection) is a certificate issued by the Sur-veyor based on the results of technical examination that is conducted in the loading country as contemplated in Decree of the Minister of Industry and Trade No. 458/MPP/Kepl7/2003.

4. 1 (one) to 1 (one) ratio shall be the ratio of purchasing of domestically produced city buses and urban buses in new condition and city buses and urban buses in non-new condition that are imported by the Non-New Bus Importer, that is liability of the Bus Operator.

5. Surveyor shall be PT. Surveyor Indonesia and PT. Sucofindo who is appointed by the Minister of Industry and Trade No. 480/MPP/Kep/7/2003.

6. Party who is appointed by Operator of City Buses/Urban Buses as meant in Article 2 paragraph (3) letter d of the Decree of the Minister of Industry and Trade No. 458/MPP/KEP/7/2003 shall be the company that has after-sale workshop that is appointed by the Operator of City Buses/Urban Buses to represent it in the agreement on cooperation of the import of non new buses with the Importer of Non New Buses."

2. To amend the provisions in Article 3 paragraph (2), so that the Article 3 entirely reads as follows:

"Article 3

(1) Experienced company as contemplated in Article 1 point 1 may apply for Recognition as Importer of Non-New Buses to the Director General of Foreign Trade, Ministry of Industry and Trade.

(2) Written application for Recognition as Importer of Non-New Buses as contemplated in paragraph (1) shall be conducted by using form of Application Letter of the Non-New Bus Importer (SPIB3) as specified in Attachment 1 by enclosing:

• a) Importer’s Identity Number (API);
• b) Corporate Registry Number (TDP);
• c) Taxpayer Code Number (NPWP);
• d) Agreement on cooperation in the purchase of non-new buses with Operators Of City Buses/Urban Buses or other parties appointed by the Operators of City/Urban Buses, duly stamped.
• e) Copy of document of Goods Import Notice (PIB) as a proof of experience in the field of import and copy of contract of cooperation/appointment for marketing of four or more wheeled vehicles as a proof of experience in the field of trading of four or more wheeled vehicles.,

(3) on the application as contemplated in paragraph (2) above, the Director General of Foreign Trade will issue either recognition or rejection of the application within 10 (ten) working days.

(4) Substance of Recognition as Importer of Non-New Buses is as specified in Attachment 2."

3. To amend the form of Letter of Application for Importer of Non-New Buses (SP-IB3) as specified in Attachment 1 and to the substance of Recognition as Importer of Non-New Buses (IB3) as specified in Attachment 2 to the Decision of the Director General of Foreign Trade No. 18/DAGLU/KP/VII/2003, to become Attachment 1 and Attachment 2 to this Decision:

Article II

This Decree shall come to effect as from the date of stipulation.
